Guardianship Weekly – Week 11: What is Section 3 Counsel and what is the relevancy under the Substitute Decisions Act to Guardianship

Section 3 of the SDA provides that in cases where an individual whose capacity is in issue in proceedings under that legislation does not have counsel, the OPGT may be directed by the court to arrange legal representation for that person (otherwise referred to as “section 3 counsel”).
